Defective Medical Devices

Personal Injury Law Firm Serving Clients Nationwide

Companies and large corporations that manufacture medical devices must use the highest standards of care to avoid device errors and defects. Otherwise, the company could be held accountable for any damages related to harm suffered by a patient using the defective medical device.

At Jackson Allen & Williams, LLP, our personal injury attorneys represent clients all around the country who have been harmed by defective or dangerous medical devices. We have seen an unfortunate trend of product manufacturer negligence that appears to be the end result of a medical and pharmaceutical industry that is more focused on profits than patient health. Whenever we take a defective medical device claim for a client, we hope not only to obtain a fair and maximized compensation amount for that client but we also want to hold the negligent company accountable so that they might never make the same mistake again and hurt someone else.

Compensation you may be able to receive in a defective medical device claim include:

  • Cost of all medical treatments related to the device, past and future
  • Wages lost as you recover from any injuries suffered
  • Future lost wages and reduced income projections
  • Damages for pain and suffering to help you find peace of mind

Different Types of Defective Medical Devices

When a medical device is safe for patient use, it can save or change a patient’s life in ways that medical alternatives could not achieve. When such a device or product is defective, it will do more harm than good.

A few defective medical devices and related health issues that have been in the news in recent years include:

  • Mirena IUD: A popular birth control device that releases hormones into a woman’s body to prevent pregnancy. Serious side effects include inflammatory diseases, severe infections, and even pseudotumor cerebri.
  • DePuy Synthes attune knee implant: A mechanical implant that helps restore mobility in the knee and leg of patients that is prone to total device failure, which can result in internal bleeding, muscle and bone loss, and other severe side effects.
  • IVC filter: A small metal device that is inserted into the inferior vena cava to catch blood clots. If the device fails, it can cause severe internal bleeding or cardiac arrest.
  • Bair Hugger surgical warming blanket: A heated “blanket” that cocoons patients after surgery to help maintain body temperature. Defects in the device can cause it to overheat patients. It is also believed to promote the growth of dangerous bacteria inside surgery patient incisions.

This list of defective medical devices in recent news stories is in no way fully inclusive. If you have been harmed due to a defect in any sort of medical device or product, let our personal injury law firm know during an initial consultation. How Medical Devices Become Defective

In a product liability case, such as those regarding defective medical devices, it must be established how and why the product or device became defective. Understanding where the defect originates can help prove the harm the patient suffered was related directly to the device in question. Our personal injury attorneys can carefully review evidence and similar cases to determine what caused the defect in the medical device that hurt you or a loved one.

There are two main ways in legal cases that a device or product can become defective:

  • Design: Some devices are dangerous by design, making it unreasonable to market the product to doctors or patients. Many defective medical devices fall into this category.
  • Manufacturing: Other medical devices are designed correctly but become dangerous due to a manufacturing error.
